Peruvians with civil rights in force are required to vote. For over seventy years of age, voting is optional.

 

Article 10 states:

The exercise of citizenship and thus the right to elect and be elected is suspended in the following cases…court decision for interdiction…

Article 113 states:

The President of the Republic may vacate for the following reasons: …

  • (2) his permanent physical or moral inability declared by Congress…

 

Article 114 states:

The office of President is suspended for:

(1) the temporary inability of the President declared by Congress…

 

Article 115 states:

In case of a temporary or permanent incapacity of the President of the Republic, the first Vice President shall assume the duties thereof, or in his absence, the second Vice President, or in case of incapacity of both, the President of Congress; whenever it is permanent, the President of Congress may call immediately an election. When the President leaves the national territory, the first Vice President is charged with his office or, in his absence, the second Vice President.

 

Article 127 states:

There is no acting Minister. The President may entrust a minister, while retaining his portfolio, to assume the duties of another on grounds of incapacity, transferring function to another ministers, but such responsibility may neither exceed thirty days nor be transferable to other ministers.
